WARRANTY TERMS AND CONDITIONS
1. The Guarantor guarantees the proper operation of the Product for the following period:
a. In the case of purchase of the Product by the consumer - 12 months
b. In the case of purchase of the Product by an entrepreneur - 1 month from the date of issue of the Product to the buyer.
2. The guarantor, as part of its guarantee, ensures the good quality of the Product. The Guarantor's liability under the warranty covers only physical defects arising from causes inherent in the sold Product. The warranty does not cover damage or defects caused by the use of the Product not in accordance with the conditions and information on the use of the Product provided by the Guarantor, contained in particular in the manual accompanying the Product.
3. Complaint under the warranty can be made, for example:
a. in writing to the address: 227 Obornicka St., Bud. E, 60-650 Poznań;
b. electronically to the e-mail address: contact@strado.en. It is recommended to specify in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the defect and photographs documenting the defect; (2) complaint request; and (3) contact details of the complainant - this will facilitate and speed up the handling of the complaint by the Guarantor. The requirements stated above are in the form of a recommendation only and do not affect the effectiveness of complaints made in disregard of the recommended method and description of the complaint.
4. At the request of the Guarantor, the warranty holder should deliver the claimed Product at the Guarantor's expense to the address: TZ POLAND S.C. 227 Obornicka St., Bud. E, 60-650 Poznań or to the place where the Product was issued when the warranty was issued, unless the circumstances indicate that the defect should be repaired at the place where the Product was when the defect was discovered. The risk of accidental loss of or damage to the Product during the time between its release to the Guarantor and its re-claim by the Warrantee shall be borne by the Guarantor.
5. Under this guarantee, the Guarantor shall be obliged to remove defects in the Product if such defects become apparent within the period specified in the guarantee. If the removal of defects in the Product proves impossible, the Guarantor undertakes to provide the warranty holder with a defect-free Product. If it is impossible to remove the defect and replace the Product with a defect-free one, or the cost of these activities exceeds the value of the Product, the warranty holder is entitled to a refund of the price paid for the Product.
6. The guarantor is obliged to perform its obligations under the guarantee immediately, no later than within 30 days working. This period shall be calculated from the date of delivery of the Product by the holder of the warranty, or from the date of filing a complaint if the circumstances indicate that the defect should be removed at the place where the Product was at the time of disclosure of the defect. The guarantor may extend the above deadline once for another 14 working days, provided that it informs the holder of the guarantee before the expiration of the original deadline for its performance, together with the reason for the delay. After exercising its rights under the warranty, the Guarantor will deliver the Product back to the warranty holder at its expense.
7. If, in the performance of its obligations, the Guarantor has delivered to the warranty holder, instead of the defective Product, a defect-free Product or has made significant repairs to the warranted Product, the warranty period runs anew from the moment of delivery of the defect-free Product or return of the repaired Product. If the Guarantor has replaced a part of the Product, the above provision shall apply accordingly to the part replaced. In other cases, the warranty period shall be extended by the time during which, due to a defect in the Product covered by the warranty, the warranty holder could not use it.
8. The warranty is valid on the territory of the Republic of Poland.
9. The warranty does not exclude, limit or suspend the buyer's rights under the warranty provisions for defects of the sold thing.
10. The Guarantor's liability to a warranty holder who is not a consumer, and as of January 1, 2021. and for contracts concluded as of that date, which is also not a natural person who enters into a contract directly related to his or her business activity, when the content of that contract shows that it does not have a professional character for that person, resulting in particular from the subject matter of his or her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity, regardless of its legal basis, shall be limited - both as part of a single claim and for all claims in total - to the amount of the price paid for the Product. In such a case, the guarantor is liable only for typical damages foreseeable at the time the contract was concluded and is not liable for lost profits.
11. The Guarantor's liability under the warranty does not include damage resulting from normal use or wear and tear, mechanical damage (cracks, scratches, damage caused by external forces, lightning, power failures, fire, flooding, high temperatures and chemical agents), damage caused by improper use, installation inconsistent with the instructions, and damage resulting from modifications, interference with the structure of the Product and structural changes made by the holder of the warranty
